Garratts Personal Injury department have successfully recovered compensation for a joiner / window fitter, who suffered serious heel fractures in ladder fall at work. At the time of the accident, the claimant was working at a job which involved the fitting of new windows to the first floor of a residential property in Manchester. The Claimant was instructed by the Defendant’s Manager to repair a damaged roof tile.
The ladder available was unsuitable for accessing and repairing the roof, being too large. As the Claimant was attempting to come down off the roof, he had to step onto the ladder from the side. As he did do, the ladder began to move and fall backwards, the Claimant jumped from the ladder to the side and fell 16 feet to the ground landing on both feet.
The Defendants made an early pre-medical evidence offer in the sum of £24,500, which Garratts Solicitors advised should be rejected outright. As part of his recovery, the Claimant had to wear ankle braces, and undergo steroid injections, and struggled with his full-time occupation. As he recovered, he relied on relatives and family for daily care.
Garratts Solicitors identified that our client should never have been sent up the ladder to carry out the roof tiling work but felt obliged to do so as a result of pressure by the company to conclude works on the residential property.
