Erroneous Prescription of an Incorrect Medication

Mrs M brought a claim against the Defendant for the erroneous prescription of an incorrect medication.

Mrs M required a specific brand of Phenytoin medication and had been receiving the same for a number of years. However, the Defendant erroneously and negligently prescribed the incorrect formulation without informing Mrs M or obtaining her consent.

The Defendants’ negligence resulted in Mrs M suffering multiple symptoms (including headaches, lethargy, disorientation, nausea and reduced appetite) as well as a prolonged period of pain.

Garratts Solicitors obtained supportive expert evidence, from a leading Consultant Pharmacologist, who identified that both the erroneous prescription of the incorrect formulation and the failure to obtain Mrs M’s consent represented negligence.
