Court and Tribunal Fee Changes

The Ministry of Justice (MoJ) has confirmed that the increase in court fees has taken effect as of 8th April 2025. It had been well publicised since the start of the year that, subject to parliamentary approval, the MoJ would implement increases to 171 court and tribunal fees in early April. These changes affect a wide range of proceedings, including family matters, civil cases, and Court of Protection applications.

The MoJ have advised that the income generated by the increase in fees will support the efficient and effective running of His Majesty’s Courts and Tribunals Service. They have stated that the fee changes will produce a significant level of additional funding that will go towards improving service delivery, subsidising the cost of related court and tribunal services which do not charge a fee and reducing the overall cost to the taxpayer.

Whilst it is positive that the Help with Fees remissions scheme will remain in place for those with lower financial means who may otherwise not be able to afford court fees, time will tell as to whether the increase will impact those individuals who are not eligible for assistance.

There is also another significant reason why being aware of when the fee increase comes into force is important. Paying the wrong court fee can be detrimental to your legal case. If the incorrect fee is paid the court is very unlikely to process and issue an application. This can lead to delays in your matter being listed for a hearing or the application simply not being actioned by court staff.
